The marketing of health care services raises the prospect that an ethic of strangers will govern relations between providers and patients. A fiduciary model that emphasizes honesty and public accountability, as well as the patient's good and avoiding unnecessary services, can keep marketing consistent with the ethical tradition of medicine.

Soltis' paper contains little data on the underlying neural substrate of the discussed signal function of early infant crying – probably because there is amazingly little known about it. We here discuss the interest of functional neuroimaging as an objective measurement of brain activity in (1) early infants during crying and (2) parents hearing their offspring cry.

Ever since Greek antiquity "disembodied knowledge" has often been taken as synonymous with "objective truth." Yet we also have very specific mental images of the kinds of bodies that house great minds--the ascetic philosopher versus the hearty surgeon, for example. Does truth have anything to do with the belly? What difference does it make to the pursuit of knowledge whether Einstein rode a bicycle, Russell was randy, or Darwin flatulent? Bringing body and knowledge into such intimate contact is occasionally seen (...) as funny, sometimes as enraging, and more often just as pointless. Vividly written and well illustrated, Science Incarnate offers concrete historical answers to such skeptical questions about the relationships between body, mind, and knowledge. Focusing on the seventeenth century to the present, Science Incarnate explores how intellectuals sought to establish the value and authority of their ideas through public displays of their private ways of life. Patterns of eating, sleeping, exercising, being ill, and having (or avoiding) sex, as well as the marks of gender and bodily form, were proof of the presence or absence of intellectual virtue, integrity, skill, and authority. Intellectuals examined in detail include René Descartes, Isaac Newton, Charles Darwin, and Ada Lovelace. Science Incarnate is at once very funny and deeply serious, addressing issues of crucial importance to present-day discussions about the nature of knowledge and how it is produced. It incorporates much that will interest cultural and social historians, historians of science and medicine, philosophers, sociologists, and anthropologists. (shrink)

From at least 1925 to the present, science and technology have been depicted largely negatively in popular films of all genres. The images of science and technology in films reflect consistent public anxiety over the linkage between science, technology, and corporate power; the complacency of government agen cies and scientists toward new knowledge and artifacts; the insensitivity of scientists toward the moral implications of their research and its applications; and the co-option of technical knowledge by vested corporate and government interests. (...) Public conservatism is reflected in the suspicion toward new knowledge and new artifacts and in questioning whether science and technology truly improve the human condition. (shrink)

While equal opportunity for all candidates is widely recognized as a goal within academia, the implementation of specific procedures to achieve equality has resulted in vehement disputes regarding both the means and ends. To encourage a reexamination of this issue, Cahn asked three prominent American social philosophers-Leslie Pickering Francis, Robert L. Simon, and Lawrence C. Becker-who hold divergent views about affirmative action, to write extended essays presenting their views. Twenty-two other philosophers then respond to these three principal essays. While (...) no consensus is reached, the resulting clash of reasoned judgments will serve to revitalize the issues raised by affirmative action. Author note: Steven M. In a recent issue of this journal, Steven Dezort criticizes two versions of the contralife argument, including my version and a version defended by some prominent new natural law theorists. In this essay, I argue that people should accept the contralife argument even if they disagree with other principles of new natural law theory. To defend this thesis, I correct some misstatements about the contralife argument and identify basic disagreements about defining actions and respecting human life.

What's left of a dream is stored at the Stanford Law School library in 12 fat green loose-leaf binders and several legal boxes of supporting documents and briefs. They chronicle the 54 days that Lawrence Lessig, the Elvis of cyberlaw, helped Judge Thomas Penfield Jackson with the mother of all tech litigation: Department of Justice v. Microsoft. It was to be Lessig's greatest moment.

Much ink has already been spilled on the relationship of constitutional originalism to precedent. The debate includes contributions from Randy Barnett, Steven Calabresi, Kurt Lash, Gary Lawson, John McGinnis with Michael Rappaport, Michael Paulsen, and Lee Strang, not to mention Justice Antonin Scalia—all representing originalism in some form. Living constitutionalism has also been represented both implicitly and explicitly, with important contributions from Phillip Bobbitt, Ronald Dworkin, Michael Gerhardt, Randy Kozel, and David Strauss. Some writers are more difficult to classify; (...) Akhil Amar comes to mind. And there are many other contributions to the debate. Opinions range from the view that precedent should invariably prevail over the original public meaning of the constitutional text to the polar opposite view, that precedent must give way to original meaning in almost every case. Here is the roadmap. Part I provides a brief introduction to contemporary originalism. Part II describes the problem of precedent for originalism, emphasizing that the nature of the problem depends in part on our understanding of precedent. This essay develops an ideal of public legal reason--a normative theory of legal reasons that is appropriate for a society characterized by religious and moral pluralism. One of the implications of this theory is that normative theorizing about public and private law should eschew reliance on the deep premises of deontology or consequentialism and should instead rely on what the author calls public values--values that can be affirmed without relying on the deep and controversial premises of particular comprehensive moral doctrines. The ideal of public legal reason is then applied to a particular question--whether welfarism (a particular form of normative law and economics) provides the sort of reasons that appropriate for legal practice. The answer to that question is no--to the extent that welfarism contends that the normative assessment of legal policies should rely exclusively on information about individual preferences, welfarism relies on deep and controversial premises of consequentialist moral theory that fail the test of public reason. The essay also investigates the thesis--advanced by Louis Kaplow and Steven Shavell--that any fairness principle (a nonwelfarist method of policy assessment) can violate weak Pareto (making everyone worse off). Whatever the implications of Kaplow and Shavell's argument, it does not show that welfarism can provide public legal reasons. The essay concludes that law's justifications should rely on normative principles that are accessible to reasonable citizens, whether they are theists or atheists, deontologists or consequentialists, moral philosophers or economists. Law's deliberations should be shallow and not deep. Law's reason should be public. (shrink)
